1.Application of the general sales conditions

The general conditions of sale described below (defined as “General Conditions” below) govern the contractual relations between the users of the website www.carlofortetonnare.com (defined as “Customers” below) and the company Carloforte Tonnare PIAM srl Carloforte Tonnare PIAM srl, Via Matteotti, 23 – 09014 Carloforte (SU) Italy, VAT n. IT01929800926. These general conditions are the only ones applicable and may be modified without prior notice and will be valid from the date of publication on the website www.carlofortetonnare.com. The validation of an order implies the tacit reading and acceptance of the general conditions present at that time on the site. Carloforte Tonnare PIAM srl reserves the right to reject any type of clause and/or document attached to the customer’s order that is in opposition to and/or adds a new element to the general conditions.

3.How to order

The product catalog is organized according to different product categories.
The Customer can get to the item card through the internal search engine and links to categories and individual items on the site. Once the product has been identified, it is possible to add it to the cart by specifying the desired quantity. In the shopping cart it is possible to change the quantities, remove items already present, proceed to fill out the order form by clicking on the Next button. Both private and business customers can purchase.
Each order is a contract between Carloforte Tonnare PIAM srl and the Customer.
Each order must be considered concluded with the acceptance, even partial, by Carloforte Tonnare PIAM srl which reserves the right to accept the order.
The acceptance is always explicit, and is communicated to the Customer at the e-mail address indicated at the time of the order. This confirmation message will contain Date and Time of the order and a “Customer Order Number” to be used in any further communication with Carloforte Tonnare PIAM srl . By placing an order, the Customer must declare that he/she has read all the information provided during the purchase procedure and fully accepts the general and payment conditions.
In case of non-acceptance of the order, Carloforte Tonnare PIAM srl undertakes to promptly notify the Customer.

4.Order form

In the order form you must enter the details of the buyer and consignee (if different) and the goods you intend to order. Delivery to PO Boxes and Post Office Holders is not permitted.
After the data is filled in, the order summary will be displayed showing the goods being purchased, partial and total amounts, VAT rates applied, shipping charges.
If the data are correct, it is possible to proceed with payment by choosing between Credit Card, PayPal, Apple Pay, Google Pay or bank transfer.
Notification of order submission and all its subsequent progress will be sent to the specified e-mail box. Registered customers can also track the progress of their orders online in the Personal Account.

5.Order cancellation

You can cancel orders not yet processed by writing to the email segreteria@carlofortetonnare.it. If the payment was made by Credit Card or PayPal, following the cancellation of the order (by the customer or by Carloforte Tonnare PIAM srl ) Carloforte Tonnare PIAM srl will request the cancellation of the transaction and the reversal of the amount paid.

6.Prices, VAT and currency

Prices quoted are inclusive of VAT. Tax documentation for companies and private customers. Goods always travel accompanied by the invoice. In addition, Carloforte Tonnare PIAM srl will send a copy of the tax invoice via e-mail in electronic PDF format when the order is processed.

7.Methods and timing of delivery

Carloforte Tonnare PIAM srl will ship the products ordered through its trusted courier, within 48 hours after receipt of payment. In the event that Carloforte Tonnare PIAM srl is not able to make the shipment within that period will be given timely notice by e-mail to the customer with an indication of the time within which the order will be processed. Carloforte Tonnare PIAM srl is not however, responsible for any delays in delivery due to unforeseen circumstances and force majeure. Delivery costs are calculated at the time of the order contextually to the place of destination, the type of payment chosen and the type of item purchased. The Customer is obliged to check at the time of delivery that the packaging is intact and that the number of packages corresponds to the number indicated on the delivery document. If there are damages to the packaging or other anomalies, the Customer must have them noted immediately on the delivery document, specifying the reason for the reservation. This is essential in order to allow Carloforte Tonnare PIAM srl, later, to forward complaints to the courier for damage and transport anomalies. In these two cases, the costs of replacement and redelivery will be borne entirely by Carloforte Tonnare PIAM srl Carloforte Tonnare PIAM srl disclaims any responsibility for the acceptance of an abnormal package not verified at the time of delivery in the presence of the carrier.

8.Payment methods

Carloforte Tonnare PIAM srl accepts payment for products ordered by major Credit Cards (Mastercard, Visa, American Express circuits), PayPal, Apple Pay and Google Pay. To use Apple Pay on carlofortetonnare.com, you must use Safari, log into your iCloud account and have a payment card added to your Wallet. To use Google Pay, you must have already set up your Google Pay account and have a payment card added to Wallet. Credit card information is handled directly by Stripe (www.stripe.com) or other banks that specialize in handling online payments; PayPal information is handled directly by PayPal. The information is encrypted through the use of state-of-the-art encryption systems that prevent its use by third parties and is sent directly to the bank.

Carloforte Tonnare PIAM srl reserves the right to make a request to the bank issuing the card for verification of genuineness on the ownership of the card itself or to PayPal in case of problems. For any reimbursement to the Buyer, if he is entitled,

Carloforte Tonnare PIAM srl will reimburse you within 14 (fourteen) days from the verification of compliance, any sums already collected for the purchase of products, by bank transfer, according to the terms and conditions. In compliance with the Anti-Money Laundering Regulations, the beneficiary of such transfer may not be a natural person other than the holder of the credit card through which payment was originally made for the purchase of the products. In the absence of this requirement, following subsequent verification and possible reports of violations, the Seller will legally retaliate against the purchaser in compliance with applicable regulations.

9.Security in transactions

Online payments take place simultaneously with the conclusion of the order transaction and in a protected and secure manner ensuring absolute privacy on the transmissions of credit card information, which therefore cannot be viewed by other users on the network. Entering and sending credit card information takes place in the utmost security thanks to the secure servers of our payment partner.The servers that execute transactions and protect Customers’ personal data employ the international 128-bit SSL security protocol.SSL encrypts the Customer’s credit card information, preventing it from being decoded by anyone other than PayPal.

10.Warranty

Carloforte Tonnare PIAM srl, reserves the right to change the information of the properties of the products, without prior notice. The picture accompanying the description sheet of a product may not be perfectly representative of its characteristics, and differ in color, size, accessory products in the picture. Carloforte Tonnare PIAM srl assumes no responsibility for any errors in the product sheets of marketed items, which must therefore be understood as purely expositive for commercial and marketing purposes. The essential characteristics of the products are presented within each item sheet.
Should the product be altered in its essential characteristics or inedible (in the case of a food product), Carloforte Tonnare PIAM srl undertakes to replace the altered goods with a new supply at its own expense.

11.Right of withdrawal

In case of:
– damage to the packaging
– failure of a product
The customer must, within 24 hours of receiving the goods, send a communication to the email address segreteria@carlofortetonnare.it indicating the order number and date of reference and the issues encountered, attaching some photographs of the products to support the claim. The request will be handled by our customer care office, and if we find that the product is unsuitable or the packaging has been damaged by the courier, we will arrange for a refund or, if necessary, a replacement delivery of the product.

12.Disputes

The sales contract between the Customer and Carloforte Tonnare PIAM srl is concluded in Italy and governed by Italian Law. For the solution of civil and criminal disputes arising from the conclusion of this contract of sale at a distance, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Cagliari – Italy.

13.Privacy Policy

Carloforte Tonnare PIAM srl guarantees that the processing of data, which may be received by e-mail or electronic forms, complies with the provisions of privacy legislation.
Anything that should reach our e-mail addresses (orders, requests, suggestions, ideas, information, etc.) will not be considered information or data of a confidential nature.
Customers of Carloforte Tonnare PIAM srl can freely access information, details of product sheets, informational texts and all those services that do not require personal data to be used.
The data relating to the holder of the credit card or prepaid card or bank account entered after the order confirmation are sent and processed exclusively by Paypal for the following purposes: completion and support of access; execution to the transaction that the user is making; execution of legal obligations; operational and management needs.

Privacy policy note
Carloforte Tonnare PIAM srl intends to carry out some processing activities of the Customer’s personal data sent via electronic mail or electronic forms (Personal Account sections related to the proposed items). These activities are necessary to satisfy the Customer’s requests, suggestions and for all commercial, fiscal, administrative and information purposes inherent to the activity of Carloforte Tonnare PIAM S.r.l.
In this regard, pursuant to and in accordance with Legislative Decree No. 196 of June 2003 (Code for the Protection of Personal Data), Carloforte Tonnare PIAM srl provides the following information about the processing we intend to carry out.

Method of processing

The processing will be carried out through the collection, processing and comparison of data and through the use of computer or telematic tools for which appropriate security measures are employed to ensure confidentiality as well as to prevent undue access to them by third parties or unauthorized parties. The activities will be carried out by means of automated and computerized procedures, exclusively at the data processing systems of Carloforte Tonnare PIAM srl or other parties linked by contractual relationships (banks, insurance entities, express courier, ISP). The data controller of personal data is the legal representative of Carloforte Tonnare PIAM srl.
Communication of personal data related to the order. The personal data entered will be used exclusively for order management, shipment of goods and invoicing.Under no circumstances will they be transferred to third parties or used to send commercial communication and advertising material.
Disclosure of data related to community registration. The data entered at the time of registration to the Personal Account may be processed for internal statistical evaluations in order to improve the quality of the commercial service.Under no circumstances will they be transferred to third parties or used for sending commercial communication and promotional communications unless there is the consent of the Customer.

14.Vexatious clauses

Art. 1341
General conditions of contract.
[I] General terms and conditions prepared by one of the contracting parties shall be effective against the other, if at the time of the conclusion of the contract the latter knew them or should have known them using ordinary diligence.
[II] [II] In any case, conditions that establish, in favor of the one who has prepared them, limitations of liability, the right to withdraw from the contract or to suspend its execution, or establish against the other contracting party forfeitures, limitations on the right to raise exceptions, restrictions on freedom of contract in relations with third parties, tacit extension or renewal of the contract, arbitration clauses or exceptions to the jurisdiction of the judicial authority shall not be effective unless specifically approved in writing.
